1. Were Plaintiffs barred from observing the actual FBI dig? Plaintiffs claimed the FBI had agreed to allow them to observe the dig while it was taking place. However, once the dig began, Plaintiffs and their associates led others to believe in posts, press conferences and magazines that they were barred from viewing the dig and made to sit in their car, only being led up to an empty hole after the dig had concluded.
The intent of these claims was clear to me: to support their theory that the FBI was hiding something, and it was repeated so often, it became fact to many, even being stated at press conference and published in magazines. Many of these claims were deleted, but some i managed to screen shot before they were taken down:
- Plaintiff on 2/1/21 : "The FBI told us we would be on site when the dig happens, and they told DCNR they could take pictures of the dig when it happened and
none of this happened."

- Plaintiffs Associate W. Gettler on 3/13/21, who was also at the dig site with Plaintiffs, stated at a Press conference, "We went there in the hopes that we would be participating, as we had been promised, in the dig for the rumored gold that Denny and Kem had been prospecting and probing for years. As it turns out, that did not happen,
we were literally barred from the site, kept in our cars and shown an empty hole afterwards" See Youtube link, starts at approx. 1:10:

The more they submitted to interviews, press conferences and online posts, and the more FBI files that were released, the more the truth started to slip out and their time on site began to grow:
-1.5 Hours on site observing the dig: By pulling together all the various statements made over the years and cross checking them, i first learned that they were actually at the site, observing the dig on day 1 from approx. 1:30pm to 3:00 PM.
-2.5 Hours on site observing the dig: In a statement made by Kem P. in the Atlantic Article (link in the opening posts), he stated they were at the actual dig site until approx. quote, "4:00 O'Clock" moving the time on site from approx. 1:30 PM to 4:00 P.M.
-3 Hours on site observing the dig: Once the FBI dig site event logs and sign in/sign out sheets were released, we learned that they were actually on site actually observing the dig, confirmed by the sign in/out sheet and further corroborated by the dig site event logs from 2:09 PM to 5:02 PM

Conclusion: We we mislead into believing they weren't allowed to observe the actual dig, that they were "barred" from the site and made to sit in their cars the entire time until the very end of the dig. When in fact, they were allowed to observe the actual dig for approximately 3 hours total. True, they weren't allowed to come and go and trample all over what the FBI considered a potential crime scene, as they apparently felt they were entitled to do, but 3 hours on site is a far cry from the 0 hours we were led to believe.
