Therefore, if you ever hear a property owner say "No, because of liability concern issues" : Trust me, the "contract" will not solve that. Trust me, they are NOT concerned about "liability concern issues". Instead, when they say : "No because of liability issues", that is only a polite way to say "no". A polite way to say "bug off".
 
Not me.

I have never even mentioned that when asking for permission. That just seems like a way to get the land owner to change their mind from "Sure, go ahead", to "I never even thought about the possibility of me being sued...so get the hell off my property!"
I never mention it first but have them in case a landowner brings up the the concern
 
thanks guys for reply Im old school myself and a handshake always was all I've ever done as well .... I know a few people who use them on farms and when going to events or when I go rock hounding at pay to dig places it's common . I've had a few permission attempts where that was the first worry mentioned ( getting hurt and sueing them) I don't believe in lawsuits 99% of the time .... it's ruined more then it's helped .

Yes. It's only a polite way to say "get lost".

But I guess : Doesn't hurt to try, if THEY bring it up. But odds are, they're still gonna say : "Get lost".

But as was stated on this thread : Don't EVER bring it up UNLESS THEY DO. Otherwise : If a total stranger hands them a contract to sign, is the FASTEST way to get a "no". It only conjures up images of hassles, legal stuff, etc....

maybe but then again I do know other detectorists that it was the only way they ended up getting permission .... I guess location may have more to do with it as well along with societies collapse from how things were in the good ole days ....i do miss the good ole days
 
Sorry, but in my world, paranoids need contracts, real people need handshakes. :waytogo: But that's just me.
yeah exactly property owners are paranoid look at how many foolish lawsuits go through US courts now a days , farms are now LLC instead of a listed under a single mans name . I miss the days when a handshake was golden and meant something
 
This just happened to me today.. I stopped and asked a elderly property owner if I could detect an abandon farm on property that he owns. He was very friendly and said sure as long as I signed a release form so I couldn't sue him in case I got injured on the property. I thought it was a reasonable request and told him I would get back to him. Is there any harm in signing a form like that?

I see no harm in it, I sign them before i go digging for cyrstals, rocks and minerals at pay to dig spots in NY and down south .
